Subsidiary Protection is protection other than Refugee Status against a grave risk of suffering serious harm such as torture, death penalty, extreme violence etc. Anyone who has an application for Leave to Remain (Section 3) can apply under subsidiary protection. It should be noted that while everyone is entitled to apply not all will qualify under subsidiary protection. It must also be highlighted that nothing in Subsidiary Protection changes the function of the Refugee Appeals Tribunal in determining whether a person qualifies for refugee status and there is no change in the current system. This is merely an addition to bring the present system in line with European Law. In order to qualify under this you must be able to demonstrate that returning to your home country would pose a grave threat to you. For details on eligibility and a complete guide on Subsidiary Protection please click here If you feel that you may be eligible to apply please contact the Refugee Legal Service or your own solicitor. If you are require further assistance please contact our office |
